The Royal Decree on Digital Platform Services went into effect in August of this year, with compliance obligations being phased in based on the size and nature of a company’s online presence. Although a main focus of the Decree relates to consumer protection, even relatively small companies or organizations without a typical “e-commerce” platform may have reporting requirements. And if your company represents a foreign entity with a global digital platform, you may have an obligation to register as the local contact in Thailand and file annual reports with the Thai regulator regarding local usage.
 
What are the criteria for a company being subject to the Decree? How does the Decree intersect with the Electronic Transactions Act and other existing Thai laws and regulations? How does it compare to similar regulations in the EU and elsewhere? Are there additional laws being considered in Thailand which may expand the scope (or eventually replace) the Decree?

Dr. Saliltorn Thongmeensuk, a distinguished research fellow at TDRI, holds a Ph.D. in Intellectual Property Law from Nagoya University (2018) and a Master's in the same field (2015). Her journey began with a Bachelor's in Law from Chulalongkorn University (2009) and a Master's in International Law from the University of New South Wales (2010). With an extensive academic background, she has seamlessly transitioned into impactful roles such as a Research Fellow at TDRI, where her focus is on Digital Law and Infrastructure Regulation, a Lecturer at Chulalongkorn University, and a Visiting Researcher at The Max Planck Institute for Innovation and Competition in Munich. Dr. Saliltorn also contributes as an Expert Fellow in the AI governance Clinic at the Electronic Transactions Development Agency (ETDA), showcasing her expertise in law and regulation regarding the digital economy and innovation.
